As a recipient of federal transit and transportation funds, Harris County must have a Disadvantaged Business Enterprise (DBE) and Small Business program to ensure nondiscrimination in the award and administration of Department of Transportation (DOT)-assisted contracts pursuant to 49 CFR Part 26. A DBE means a for-profit small business concern that is at least 51 percent owned by one or more individuals who are both socially and economically disadvantaged or, in the case of a corporation, in which 51 percent of the stock is owned by one or more such individuals; and whose management and daily business operations are controlled by one or more of the socially and economically disadvantaged individuals who own it.

Harris County Commissioners Court has established a policy to ensure that DBE’s have an equal opportunity to receive and participate in DOT-assisted contracts pursuant to 49 CFR Part 26.23 and has designated Gene Simeon as the DBE Liaison Officer for DBE program matters pursuant to 49 CFR Part 26.25.

Harris County has adopted a Texas Department of Transportation (TXDOT DBE) Memorandum of Understanding (MOU) establishing a federally approved DBE program pursuant to 49 CFR Part 26. This MOU allows Harris County to adopt the Texas Unified Certification Program (TUCP) Memorandum of Agreement (MOA) establishing participation in the TUCP as a Non-Certifying Partner pursuant 49 CFR Part 26.81. The objective of the TUCP is to make all certification and decertification decisions on behalf of all TUCP Partners with respect to participation in the TXDOT DBE Program.
